Terms and Conditions

This Terms and Conditions document applies to Miami Fenix Football Club and all associated websites and domains. By completing the registration process, the parent or legal guardian confirms they have read, understood, and agreed to the following terms:

Registration and Payment
By enrolling a participant in any program administered by Miami Fenix Football Club, the parent or legal guardian acknowledges and agrees that registration shall not be deemed complete until full payment is received and processed through the authorized payment platform. Monthly training fees are due on the second calendar day of each month. All payments are final, non-refundable, and must be submitted electronically via the Club’s designated payment processor.

Participant Health and Conditions
The parent or legal guardian affirms that the participant is physically and mentally fit to engage in athletic training and soccer-related activities. Any known medical conditions, including but not limited to asthma, seizures, or severe allergies, must be disclosed to Miami Fenix Football Club prior to enrollment. The Club does not guarantee accommodation for any medical condition, and reserves the right to deny or revoke participation in its sole discretion based on safety and health concerns.

Liability Waiver and Assumption of Risk
Participation in athletic activities involves inherent risk. By enrolling in any program offered by MiamiFenix Football Club, the parent or legal guardian voluntarily assumes all risk associated with participation, including but not limited to injury, accident, or illness. The parent or guardian hereby releases and discharges Miami Fenix Football Club, its directors, officers, employees, agents, affiliates, and volunteers from any and all liability for claims, demands, or causes of action related to injuries or damages arising directly or indirectly from participation in any Club-sponsored activity.

Emergency Medical Authorization
In the event of a medical emergency, the parent or legal guardian authorizes Miami Fenix Football Club staff to take reasonable action to contact emergency medical services on behalf of the participant. The Club and its staff shall not be held responsible for any medical outcome. All costs related to emergency treatment shall be the sole responsibility of the parent or guardian. This authorization is intended solely to allow staff to act promptly in contacting appropriate emergency services and shall not be construed as creating any liability for medical care or decision-making.

Media and Promotional Release
By enrolling a participant, the parent or legal guardian grants Miami Fenix Football Club the irrevocable and unrestricted right to use the participant’s name, image, video, or likeness for promotional, marketing, and training purposes, including but not limited to the Club’s website, social media platforms, printed materials, and digital advertising. This consent is granted without limitation as to duration or geographic scope.

Conduct and Disciplinary Action
Participants and parents are expected to conduct themselves in a respectful and orderly manner at all times. Any behavior, including but not limited to aggression, harassment, bullying, verbal abuse, or disregard for staff instructions, may result in immediate suspension or permanent removal from the program, at the sole discretion of Miami Fenix Football Club. No refunds shall be issued in connection with disciplinary removals.

Prohibited Items and Substances
Weapons, illicit drugs, alcohol, and any controlled substances not expressly authorized by a physician for the participant’s personal medical use are strictly prohibited on the premises of any Miami Fenix Football Club event or facility. Violations of this policy will result in immediate expulsion from all Club activities without refund.

Damage to Property and Valuables
Miami Fenix FC is not responsible for lost or stolen personal belongings. Any property damage caused by a participant, whether intentional or accidental, may result in financial liability to the parent or guardian.

Privacy Policy
Miami Fenix Football Club is committed to safeguarding the personal information of its participants and their families. Information collected during registration, including names, addresses, contact information, medical disclosures, and payment details, is used solely for administrative, scheduling, billing, and emergency purposes. Personal data is stored securely and is never shared with third parties for marketing or solicitation purposes. Information may be disclosed to emergency personnel or law enforcement if required by law or deemed necessary to protect the health and safety of participants.

Right of Refusal and Termination
Miami Fenix Football Club reserves the absolute right to deny or revoke participation to any individual whose behavior or payment history is inconsistent with the Club’s standards or policies. Continued enrollment is subject to compliance with these Terms and Conditions and the sole discretion of Club leadership.

Cancellation and Refund Policy
Cancellation requests must be submitted in writing to info@miamifenixfc.com before the first of the month to avoid being charged for the upcoming cycle. Requests submitted after the first will apply to the following month. No refunds will be issued under any circumstances, including missed sessions or early withdrawal. Miami Fenix FC reserves the right to reschedule or cancel sessions due to weather or unforeseen operational issues. Refunds will not be issued in such cases.

Governing Law and Dispute Resolution
This agreement shall be governed by the laws of the State of Florida. Any dispute, controversy, or claim arising out of or relating to these terms shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Such arbitration shall take place in Miami-Dade County, Florida. Each party shall bear its own costs, and the decision of the arbitrator shall be final and enforceable in a court of competent jurisdiction.
